Art. 2
Scope
#
These Terms govern exclusively:
- the purchase of Tasty;
- the use of Tasty in digital and paper form;
- the management of the related balance;
- the transfer of Tasty between users;
- promotions, promotional codes and free gifts (Arts. 5, 17 and 18);
- the optional game activities of the webapp: Gelato itineraries, People’s Jury ratings, status recognitions, free products and product-bound credit (Arts. 18-bis et seq.);
- registration for and use of the webapp;
- the booking of free events;
- waiting lists;
- how booked events are accessed;
- support and complaints relating to the above services.
They apply regardless of the official channel used: the sherbeth.it website, the webapp, the on-site tills or any further authorised channels.
These Terms do not, however, govern the relationships between Sherbeth and gelato makers, exhibitors, sponsors, partners, jury members, suppliers or other professional operators.
Art. 3
The event
#
Sherbeth Festival 2026 will take place in Palermo from 13 to 16 November 2026, mainly in Piazza Verdi and in the stretch of Via Maqueda in front of Piazza Verdi.
General access to the Festival area is free of charge.
Payment relates exclusively to tastings and to any services expressly indicated as chargeable.
Art. 4
Definition of Tasty
#
A Tasty is the internal unit used within Sherbeth Festival to obtain tastings.
The ordinary purchase value is 1 Tasty = € 1.00.
The price shown to the consumer is the final price and will not subsequently be increased by booking fees or other costs not communicated in advance.
Tasty are not legal tender, do not bear interest and cannot be converted into money, except in the cases of refund expressly provided for by these Terms or by law.
Art. 5
Packages available
#
Tasty may be purchased exclusively in the following packages, at the same price in the webapp and at the on-site tills:
| Package | Tasty | Final price | Purchase gift (webapp only) |
| Giretto |
5 Tasty |
€ 5.00 |
none |
| Viaggio |
10 Tasty |
€ 10.00 |
2 Conetti |
| Grand Tour |
25 Tasty |
€ 25.00 |
3 Conetti |
The minimum purchase is therefore 5 Tasty. Each package may be purchased several times, including as a top-up of an existing balance, with no quantity limits and subject to product availability.
The Viaggio and Grand Tour packages include, respectively, 2 and 3 free Conetti (“purchase gift”). The purchase gift is granted exclusively for purchases completed in the official webapp with online payment and is credited to the purchaser’s profile when payment is confirmed, in the form of product-bound credit pursuant to Art. 18-septies. The final price includes no consideration for the free Conetti.
At the on-site tills the same packages are sold at the same price and with the same quantity of Tasty, but without the purchase gift, whatever the means of payment used and whatever the medium, paper or digital, to which the Tasty are credited. The promotional codes referred to in Art. 17, on the other hand, may be used both in the webapp and at the on-site tills.
The Organisation may withdraw individual packages from sale, introduce new ones or offer, for set periods announced through the official channels, a promotional price or additional Tasty on one or more packages. Changes take effect for subsequent purchases; purchases already completed remain valid on the terms in force at the time of the order, including the purchase gift then provided.
Tasty purchased with any package and through any channel have the same value and the same conditions of use, transfer, validity and expiry (Arts. 11, 12, 13 and 14).
Art. 6
Sales channels and sales period
#
Online sales of Tasty will begin on 16 October 2026.
Tasty may be purchased:
- through the official Sherbeth webapp, upon registration;
- at the tills located in the Festival area.
Sales may continue until the end of the event.
The Organisation may however suspend sales early or temporarily depending on product availability, attendance, opening hours, safety requirements or the time actually remaining in which to use the Tasty.
Art. 7
Means of payment
#
For online purchases, the means of payment indicated from time to time on the platform will be available.
At the on-site tills, cash, payment cards and card-terminal payments will be accepted.
No surcharges will be applied to the final price displayed or communicated to the customer, except under particular conditions clearly indicated in advance.
Art. 8
Completion of the online purchase
#
The online purchase contract is deemed concluded when payment has been authorised and the user receives the order confirmation.
The confirmation sent to the user contains at least:
- the order reference;
- the quantity of Tasty purchased;
- the amount paid;
- the date of purchase;
- confirmation that the Tasty have been credited to the profile;
- a link to these Terms;
- a link to the support service.
For purchases at the tills, the contract is completed upon payment and delivery or activation of the Tasty.
Art. 9
Digital Tasty
#
Tasty purchased online are credited to the user’s profile. A QR code is associated with the user, to be used at the tasting kiosks. Each use immediately updates the available balance.
Art. 10
Paper Tasty
#
Paper Tasty may be purchased at the fixed or mobile tills set up in the Festival area, in the same denominations set out in Art. 5, with no obligation to register on the webapp. Upon payment, the till issues the user a receipt bearing a QR code representative of the Tasty purchased.
The paper QR code is used by showing it to the gelato maker at the tasting kiosk: at each scan, the number of Tasty corresponding to the tasting requested is deducted from the remaining balance of that medium. The paper QR code contains only an anonymous identification code and no personal data, in compliance with data protection legislation; by scanning it with a mobile device its remaining balance can be checked without any need to register.
Tasty purchased at the tills and Tasty purchased through the webapp are equivalent and may be spent at all tasting kiosks. It is understood that the same Tasty may under no circumstances be used more than once.
At any time, and in any case no later than the end of the event, a registered user may import onto their own digital profile the remaining balance of a paper medium, in whole or in part, by scanning the QR code from the relevant section of the webapp. The user indicates how many Tasty they wish to import; the imported Tasty are deducted from the paper medium and credited to the profile, while any remainder stays on the paper medium and may continue to be used at the kiosks. The import may be repeated several times on the same medium, up to its remaining balance.
Importing is carried out exclusively by the users themselves from the webapp, by the authenticated user and onto their own profile; it is not possible to import a paper medium onto another user’s profile. At the tills a paper medium can be checked, but importing onto a profile is not a till operation.
The reverse operation is likewise permitted: a registered user may transfer from their own profile onto a paper medium, in whole or in part, the Tasty they wish, for example in order to give them to people who do not have a profile. The transferred Tasty are deducted from the profile and made available on the paper medium. The IT system guarantees the uniqueness of the credit: the user’s overall balance is never duplicated and at any given moment each Tasty exists on one medium only.
A paper medium is not associated with a person: tastings paid for with a paper QR code do not award stamps on the Gelato itineraries (Art. 18-ter) and do not open the right to rate (Art. 18-quater). To take part in those activities the user must import the Tasty onto their own profile before the tasting and pay with the profile’s QR code.
Art. 11
Use and cost of tastings
#
As at the date of publication of these Terms, the following are available:
| Tasting | Cost |
| Conetto |
1 Tasty |
| Cup |
3 Tasty |
| Biscotto-gelato by COOKIE MAKER |
4 Tasty |
There are no maximum tasting limits per user, per order or per day, subject to the available balance and to product availability.
Exceptionally, and for justified organisational or commercial reasons, the Organisation may change the number of Tasty required for individual tastings.
Changes will be communicated in advance through one or more official Sherbeth channels and will take effect only for tastings requested after they come into force. The nominal balance of Tasty already purchased will remain unchanged.
Art. 12
Sharing and transferring Tasty
#
Tasty may also be used to offer tastings to other people.
Digital Tasty may be transferred between profiles, in whole or in part, several times and to different users. Transfers concern whole numbers of Tasty, with a minimum of 1 Tasty, and are not subject to any multiples.
A transfer requires the transferring user’s profile to be active and the balance to be sufficient; transferring to oneself is not permitted. Once confirmed, a transfer is final and irrevocable: no cancellation procedure is provided. Paper Tasty may be freely passed on.
Transferred Tasty keep the expiry they had for the person who transferred them: a transfer does not create new credit and in no way extends the time limit for use set out in Art. 14.
Product-bound credit under Art. 18-septies cannot be transferred, either between profiles or onto a paper medium. Free Tasty under Arts. 17 and 18, on the other hand, may be transferred on the terms of this article.
Art. 13
Period of validity
#
Sherbeth Festival 2026 Tasty may be used exclusively during the 2026 edition and, save for changes to opening hours communicated by the Organisation, in the following periods:
| Day | Tasting hours |
| Friday 13 November |
16:00 - 24:00 |
| Saturday 14 November |
10:00 - 24:00 |
| Sunday 15 November |
10:00 - 24:00 |
| Monday 16 November |
16:00 - 19:00 |
Depending on product availability, attendance and operational requirements, the Organisation may extend or reduce the hours of sale and/or service.
If the hours are extended, Tasty remain usable until the new closing time communicated, without prejudice to the expiry time set out in Art. 14.
Art. 14
Expiry of Tasty
#
Tasty — whether purchased, free or imported from a paper medium — and product-bound credit for free products (Art. 18-septies) expire at 23:59:59 on 16 November 2026. From that moment:
- Tasty may no longer be used;
- they may no longer be transferred;
- any remaining balance will remain visible in the account history as expired;
- the balance may not be used at later editions of Sherbeth;
- any remaining balance may not be converted into money or refunded, save for the mandatory rights provided by law.
Paper Tasty must bear an indication that their validity is limited to Sherbeth Festival 2026.
Art. 15
Product availability
#
Individual flavours and products are available while stocks last.
The unavailability or sell-out of a specific flavour, product, individual kiosk or individual gelato maker does not give rise to any right to a refund of Tasty, provided that other tasting options remain genuinely available.
Any changes to the participating gelato makers, flavours, guests, programme, talks, timings or activities do not in themselves give rise to a right to a refund.
A general sell-out of products does not automatically give rise to a right to a refund of any remaining balance, without prejudice to the mandatory rights of consumers where the relevant conditions are met.
Art. 16
Queues and temporary unavailability
#
Queues, waiting times, crowding, temporary suspensions of service, the temporary unavailability of a kiosk or other similar circumstances do not give rise to a right to a refund of Tasty where the credit can be used later or at other kiosks within the period of validity.
Art. 17
Promotions and promotional codes
#
Sherbeth may offer promotional codes, partner agreements, special offers, promotional packages, free Tasty and free products, and initiatives reserved for particular categories, including in collaboration with sponsors and partners.
Promotional codes may be of four kinds:
- codes that reduce the order amount by a percentage;
- codes that reduce the order amount by a fixed sum;
- codes that do not affect the price and which, once payment is confirmed, credit an additional quantity of free Tasty pursuant to Art. 18;
- codes that do not affect the price and which, once payment is confirmed, credit one or more free products in the form of product-bound credit pursuant to Art. 18-septies.
Each code has an expiry date and a maximum total number of uses; it may also be reserved for specific users, limited to a maximum number of uses per user and limited to specific packages. A code that has expired, has been used up or revoked, is reserved for other users, has already been used by the user the maximum number of times allowed or is not valid for the packages in the order is refused when it is applied, with an indication of the reason.
Only one promotional code may be applied to each order; codes cannot be combined with one another, unless expressly stated otherwise. A code may, however, be combined with the purchase gift under Art. 5: free products awarded by a code and those included in the package, where they relate to the same product, are added together.
A promotional code is deemed used only and exclusively when the transaction has actually taken place: in the webapp, when payment is confirmed; at the on-site tills, when the purchase transaction is completed. Only from that moment does it count towards the maximum total number of uses and the maximum number of uses per user. Entering the code in the webapp basket and submitting the order amount to a mere check of formal validity and do not use up the promotional entitlement: accordingly, an order that is abandoned, cancelled or whose payment fails does not use up the code, which remains usable subject to its original terms. The discount applies to the order amount; free Tasty and free products are credited only once payment is confirmed.
At the on-site tills promotional codes can be used without registration: per-user usage limits do not apply and codes reserved for specific users are not accepted. Free products awarded by a code require a profile to which they can be credited: for purchases of paper Tasty under Art. 10, a code of the fourth kind produces no credit.
Promotional codes may be suspended or revoked in the event of fraudulent or anomalous use. The Organisation may amend, suspend or discontinue a promotion for organisational or technical reasons or in the event of abuse. In any event, purchases already duly completed on the promotional terms before the suspension shall remain fully valid.
The Trenitalia Promotion is governed by Art. 18-octies.
Art. 18
Free and promotional Tasty
#
Free Tasty may be distributed through sponsors, partners, promotional campaigns, social media initiatives, accreditations, press, influencers, promotional codes of the third kind under Art. 17, the Trenitalia Promotion under Art. 18-octies and other initiatives authorised by the Organisation.
Unless otherwise stated, free Tasty are Tasty for all purposes: they are used at all tasting kiosks in accordance with Art. 11, transferred in accordance with Art. 12, usable during the periods set out in Art. 13 and expire in accordance with Art. 14. They cannot be converted into money, are not refundable and, once expired, cannot be reactivated. The price of any purchase includes no consideration for free Tasty.
Free credit, whatever its origin, is used before purchased credit. At each tasting the system automatically deducts, in this order: free Tasty; the credit bound to the product requested (Art. 18-septies); Tasty imported from a paper medium; and finally purchased Tasty. The order of use cannot be changed by the user.
For each edition the Organisation may set a maximum amount of free credit that can be awarded to each person. The limit, where set, is communicated through the official channels and applies to the total free credit issued to the person in the edition, whatever its origin. No limit is set for the 2026 edition. Once any limit is reached, further gifts are not credited, without this affecting the tastings, stamps or ratings that generated them.
For the Organisation’s internal accounting purposes only, each free Tasty is assigned a notional value equal to the ordinary purchase value set out in Art. 4; this value cannot in any way be claimed by the user.
Art. 18-bis
Festival game activities: principles and definitions
#
The official webapp offers optional game activities — the Gelato itineraries with their stamps, the People’s Jury ratings and status recognitions — which accompany the visit and may award free products. Participation is free and voluntary and is in no case a condition for purchasing Tasty, for obtaining tastings or for booking events.
These activities do not constitute a prize competition or prize operation within the meaning of Italian Presidential Decree no. 430 of 26 October 2001, since they are cultural, recreational and promotional events awarding recognitions of modest value and/or ancillary discounts directly linked to the tasting activity. There is no element of chance or randomness, the recognitions are awarded automatically and deterministically upon the occurrence of objective, predetermined and verifiable conditions, and consist exclusively of free products spendable within the event or of status recognitions having no economic value and not convertible.
The questionnaire referred to in Art. 18-ter is open to everyone and does not require logging in to the webapp; enrolling in the Itineraries requires only logging in. The award of stamps, rating rights and gifts is, on the other hand, reserved for registered users with a verified email address, with one account per person, and requires tastings to be paid for with the QR code of the user’s own profile. Tastings paid for with paper Tasty (Art. 10) or with another user’s QR code are not attributed to the person and produce no stamps, rating rights or gifts.
For the purposes of Arts. 18-bis et seq.:
- “Conetto” means the basic tasting referred to in Art. 11, costing 1 Tasty;
- “free product” means a tasting among those referred to in Art. 11 awarded without consideration and credited as product-bound credit pursuant to Art. 18-septies;
- “Gelato itinerary” or “Itinerary” means a set of stops published in the webapp, each corresponding to a participating gelato maker, in accordance with Art. 18-ter; each gelato maker belongs to one Itinerary only;
- “stamp” means the automatic recording in the webapp of a tasting at the gelato maker of a stop, attributed to the Itinerary to which that gelato maker belongs;
- “rating” or “vote” means the assessment of a tasting given by the user in accordance with Art. 18-quater;
- “Grand Juror” means the status recognition referred to in Art. 18-quinquies;
- “People’s Choice Award” means the recognition awarded to a gelato maker in accordance with Art. 18-sexies.
Data relating to participation in the game activities — enrolments in Itineraries, stamps, ratings — are processed for the performance of these Terms, for the award of gifts and for determining the People’s Choice Award. Any use of such data for profiling purposes remains subject to the consent referred to in Art. 62.
The Organisation may introduce, amend or suspend individual mechanics for organisational or technical reasons and in the event of abuse. Amendments take effect for the future and do not affect free Tasty and free products already credited. Features that these Terms describe as active “from the date announced through the official channels” take effect only from that date and, before it, confer no right.
Art. 18-ter
Gelato itineraries
#
The Gelato itineraries are the themed routes published in the webapp for the 2026 edition: ten Itineraries, each made up of stops — normally six — identifying a participating gelato maker, the flavour suggested by the Itinerary and the location of the relevant kiosk. Each gelato maker belongs to one Itinerary only. The Itineraries, the stops and any features indicated (for example Itineraries made up exclusively of vegan, lactose-free or lighter gelato) are those published in the webapp and at sherbeth.it/percorsi/. The Organisation may update them according to the gelato makers actually present and to organisational requirements; updates do not affect stamps and gifts already awarded.
A registered user may enrol in one or more Itineraries from the webapp, either from the list of Itineraries or from the result of the questionnaire referred to in the following paragraph. Enrolment is free of charge, is allowed only once for each Itinerary and per person and concerns only the Itineraries published for the current edition. The Itinerary in which the user is enrolled serves as a “passport”: it shows the stops already stamped and those still to be visited and indicates the next kiosk. There is no limit on the number of Itineraries followed at the same time.
The “What gelato are you?” questionnaire is optional: based on the answers to five questions and on the dietary preferences stated, including allergens to be excluded, it suggests an Itinerary without binding the user, who remains free to enrol in any Itinerary. The questionnaire may be repeated and awards no gifts or recognitions.
A stamp is awarded automatically, at no additional cost, for each tasting paid for with the QR code of the user’s own profile at the kiosk of a gelato maker that is a stop on an Itinerary, whichever of the formats set out in Art. 11 and whichever flavour is chosen, even one other than the flavour suggested by the Itinerary. The stamp is attributed to the Itinerary to which that gelato maker belongs. Tastings made before enrolment are also recognised: upon enrolment in an Itinerary, the tastings already paid for at the gelato makers belonging to it are recognised automatically and the related stamps appear in the passport. Each stop is worth one stamp only, even if the gelato maker is tasted several times. Stops may be completed in any order. Tastings paid for with paper Tasty and tastings paid for with another user’s QR code award no stamps.
An Itinerary is deemed completed when the last missing stop is stamped, including where, as a result of the recognition of earlier tastings, this happens at the moment of enrolment. Completing any Itinerary awards 1 free Conetto, credited automatically to the profile as product-bound credit pursuant to Art. 18-septies, whichever package was purchased — Giretto, Viaggio or Grand Tour — and whichever channel the Tasty were purchased through. The gift is awarded only once for each Itinerary and per person. It is credited after the stamp is recorded: any temporary inability to credit it, including because of the limit under Art. 18, does not cancel the completion, which remains recorded in the passport.
The number of distinct gelato makers at which the user has made at least one tasting with the QR code of their own profile also determines an explorer level — Explorer (5 gelato makers), Taster (15), Gelato Lover (30), Gelato Hunter (45), Sherbeth Legend (60) — shown in the webapp. Levels are exclusively status recognitions within the meaning of Art. 18-quinquies and award no Tasty or gifts.
Art. 18-quater
Votes and reviews: the People’s Jury
#
Each tasting paid for with the QR code of the user’s own profile opens the right to rate the gelato tasted. A rating consists of three criteria — Taste, Texture and Presentation — each scored from 1 to 10; a written comment is optional and does not affect the gifts awarded. The overall score shown in the webapp is the average of the three criteria, scaled proportionally to a maximum of 5; for the purposes of the People’s Choice Award the scores of the three criteria are added together (Art. 18-sexies).
- only one rating is allowed for each gelato maker in the edition, whatever the number of tastings made there and whatever the format and flavour chosen;
- a rating may be given from five minutes after the tasting;
- ratings are accepted until 23:59:59 on 16 November 2026; for the purposes of the People’s Choice Award only ratings submitted by 23:59 on 15 November 2026 are counted (Art. 18-sexies);
- only users registered with a verified email address may rate, with one account per person;
- once submitted, a rating cannot be changed by the user.
Tastings paid for with paper Tasty or with another user’s QR code open no right to rate. The right to rate lapses if the tasting is cancelled.
For every six ratings submitted in the edition — on the sixth, the twelfth and so on up to the sixtieth — 1 free Conetto is awarded, actually usable for a tasting: it is credited automatically to the profile as product-bound credit pursuant to Art. 18-septies, up to a maximum of 10 Conetti per person in the edition. No gift is awarded for the individual ratings falling between one band and the next.

Crediting is automatic and immediate upon reaching each band; each band is recognised only once per person. Any inability to credit does not prevent the rating from being submitted.
Ratings are not subject to prior moderation. The Organisation may check them afterwards: in the case of inauthentic or automatically generated ratings, ratings relating to tastings not paid for by the user or ratings otherwise resulting from abuse, it may exclude them from the calculation of the People’s Choice Award, withhold the related gifts and, in the most serious cases, apply Art. 31.
Scores are used to calculate the People’s Choice Award (Art. 18-sexies), for the average score shown in the webapp and to count ratings for the purposes of the gifts and of the Grand Juror recognition (Art. 18-quinquies).
Art. 18-quinquies
Grand Juror and status recognitions
#
A user who has submitted at least 25 ratings in the edition pursuant to Art. 18-quater obtains the “Grand Juror” recognition. The recognition consists exclusively of a badge shown on the webapp profile: it awards no Tasty or gifts, does not change the weight of ratings — each rating counts only once in the calculation of the People’s Choice Award, even when given by a Grand Juror — and confers no further contractual right.
The Grand Juror recognition is active from the date announced through the official channels, pursuant to the last paragraph of Art. 18-bis. From that date all ratings submitted in the edition are counted, including earlier ones.
Status recognitions — Grand Juror, the explorer levels referred to in Art. 18-ter and any further badges introduced — may be accompanied by shareable badges, invitations or priority access. Such recognitions confer no further contractual rights, do not alter the booking rules set out in Part II and remain in all cases subject to capacity and to safety requirements.
Art. 18-sexies
People’s Choice Award and Users’ Award
#
The People’s Choice Award is awarded, among the gelato makers taking part in the Procopio Cutò International Award with a competing gelato duly delivered, to the one obtaining the highest sum of the scores of the People’s Jury ratings given pursuant to Art. 18-quater on tastings made at their kiosk in the Gelato Makers’ village. For each rating the scores of the three criteria are added together; neither the average nor the number of tastings is taken into account.
The calculation is automatic. The ranking is frozen at 23:59 on 15 November 2026 and takes into account only the ratings submitted by that time and the gelato makers whose delivery for the competition was accepted by the same time. Ratings submitted after that time, which are accepted until 16 November 2026 (Art. 18-quater), do not count towards the Award. In the event of a tie the Award is shared ex aequo. The People’s Choice Award is announced on the closing evening of the event.
The People’s Choice Award is a recognition for the gelato maker and gives users no Tasty, gift or other right; relations between the Organisation and the gelato makers remain outside these Terms pursuant to Art. 2.
The Organisation also keeps a ranking of the users who have submitted the largest number of ratings in the edition (“Users’ Award”), for the purposes of any status recognitions pursuant to Art. 18-quinquies. The ranking does not automatically award Tasty or gifts.
Art. 18-septies
Free products and product-bound credit
#
Free products — the Conetti of the purchase gift (Art. 5), of promotional codes of the fourth kind (Art. 17), of the completion of Itineraries (Art. 18-ter) and of the People’s Jury ratings (Art. 18-quater), as well as any further products the Organisation decides to award — are credited to the user’s profile as product-bound credit: a credit, expressed in Tasty, equal to the price in Tasty of the product in force at the time of the award, usable exclusively for tasting that product at the kiosks offering it.
Product-bound credit:
- may be used only for the product to which it is bound: a free Conetto cannot be used, even in part, for a Cup, a Biscotto-gelato or other formats;
- cannot be transferred, either between profiles or onto a paper medium (Art. 12);
- cannot be converted into money and is not refundable;
- is usable during the periods set out in Art. 13 and expires at 23:59:59 on 16 November 2026 in accordance with Art. 14, like other Tasty;
- is deducted automatically when the corresponding product is tasted, according to the order of use set out in Art. 18;
- is shown on the webapp profile separately from the Tasty balance.
Free products are credited when payment is confirmed, for the purchase gift and promotional codes; when the Itinerary is completed, for the Gelato itineraries; and upon reaching each band, for the People’s Jury ratings. Any failure to credit for technical reasons does not affect the validity of the purchase, the completion of the Itinerary or the ratings submitted; the user may report it pursuant to Art. 23.
The price of any purchase includes no consideration for free products. For the Organisation’s internal accounting purposes only, each free product is assigned a notional value equal to its price in Tasty multiplied by the ordinary value set out in Art. 4; this value cannot in any way be claimed by the user.
Art. 18-octies
Trenitalia Promotion
#
The Trenitalia Promotion is reserved for purchases of packages made at the on-site tills in the Festival area and is active from the date announced through the official channels, pursuant to the last paragraph of Art. 18-bis, until the end of the event or until such other date as is announced.
Anyone purchasing a package at the till who shows a Trenitalia travel ticket to Palermo with a travel date within the week of the event (from 9 to 16 November 2026) receives a single-use promotional code which awards, in addition to the Tasty purchased and without any reduction in price, free Tasty equal to 20 % of the quantity of Tasty purchased in the same transaction. For holders of the Trenitalia XGO card, shown together with the travel ticket, the percentage is 25 %.
The code is single-use: it is valid for one purchase transaction only and is associated with one travel ticket only, and each travel ticket entitles the holder to one code only. The quantity of free Tasty is rounded down to the whole Tasty and is credited to the same medium, paper or digital, to which the Tasty purchased in the same transaction are credited.
The free Tasty of the Promotion are free Tasty within the meaning of Art. 18: they are used, transferred and expire like other Tasty and cannot be converted into money or refunded. The Promotion is a promotional code within the meaning of Art. 17: it cannot be combined with other codes in the same transaction, but it is added to the gifts from the game activities under Arts. 18-bis et seq.
The travel ticket and the XGO card are shown at the till solely for an on-the-spot visual check of the requirements for unlocking the Promotion; they are in no way retained, photocopied or scanned. Solely for the purpose of preventing abuse and fraud, the till system will record only an anonymous control identification code, in full compliance with Regulation (EU) 2016/679 (GDPR), without storing any personal data relating to the traveller.
Trenitalia is not a party to these Terms. The Promotion is an initiative of the Organisation and may be amended, suspended or discontinued pursuant to Art. 17; purchases already completed on the promotional terms remain valid.
Art. 19
Right of withdrawal and change of mind
#
Tasty are intended exclusively for the use of tasting services within Sherbeth Festival 2026, an event with a specified period of performance.
To the extent that Art. 59(1)(n) of the Italian Consumer Code applies, there is no right of withdrawal for a mere change of mind in relation to online purchases.
Once payment has been made, an order cannot be cancelled or refunded on grounds of:
- a change of mind;
- non-attendance;
- illness;
- personal impediments;
- changes to travel plans;
- a mistake by the user as to the quantity purchased;
- any other cause attributable to the purchaser.
Any mandatory rights provided by law are in all cases unaffected.
Art. 20
Cancellation of the event and force majeure
#
In the event of cancellation, suspension, interruption or modification of the event due to circumstances not attributable to the Organisation — such as, by way of example, natural disasters, earthquakes, exceptional weather events, measures taken by government or the authorities, emergencies, or reasons of public order or safety — no automatic refund of Tasty is provided for.
The Organisation will announce the measures actually applicable to the specific circumstance. In any event, the mandatory rights granted to consumers by the applicable legislation remain unaffected.
Where, on the other hand, the cancellation of the event is due to a decision or a cause attributable to the Organisation, the purchaser may request a refund of the Tasty purchased and not used.
Art. 21
Refund procedure
#
In cases where a refund is granted, Sherbeth will open a dedicated section on sherbeth.it.
The request must be submitted, following the procedure indicated, within 7 days of the official announcement of the cancellation, without prejudice to any mandatory time limit provided by law.
The following may be requested:
- first name and surname;
- the order reference;
- the quantity of Tasty;
- IBAN;
- the account holder;
- any further data strictly necessary for verification.
The refund will be made by GOOD EVENT SRL by bank transfer within 30 days of the request being accepted.
Art. 22
Payment errors
#
In the event of a double charge, a payment in excess of the amount due or an established technical error attributable to the payment system, GOOD EVENT SRL will, after the necessary checks, refund the amount wrongly charged.
Art. 23
Tasty not credited
#
Where payment has been correctly made but the Tasty are not credited to the profile, the user must report this through the support form on sherbeth.it. Once the payment has been verified, the Tasty will be credited manually to the profile.
Art. 24
Technical malfunctions
#
In the event of a temporary malfunction of the webapp, the QR code, the connection or other technological systems, users may go to the tills or to the support points.
The Organisation may check the balance, carry out manual checks and adopt temporary alternative ways of using the Tasty.
A temporary disruption that does not result in the loss of credit and that subsequently allows the Tasty to be used does not give rise to a right to a refund.
Sherbeth is not liable for disruptions attributable exclusively to telephone operators, internet providers, payment processors, hosting providers or other third parties, without prejudice to the mandatory obligations provided by law.
Art. 25
Balance recorded in the system
#
In the event of a dispute concerning purchases, transfers, uses or remaining balance, the data recorded in the Sherbeth system are the principal reference, save for proof of a technical error or other evidence admitted by the applicable sector legislation.
Art. 26
Loss and unauthorised use
#
Tasty already used are not refunded or restored in the event of loss, theft, sharing of the QR code, disclosure of the code to third parties or unauthorised access to the account, unless a technical malfunction directly attributable to the Sherbeth system is established.
Art. 27
Lost or damaged paper Tasty
#
Paper Tasty not linked to an account cannot be replaced or refunded in the event of loss, theft, destruction or deterioration such as to make them unverifiable.
A deteriorated paper medium remains usable provided its code or QR code is still legible and can be validly verified by the system.
Art. 28
Counterfeiting and fraudulent use
#
Counterfeit, altered, duplicated or non-validly verifiable paper Tasty may be refused. Duplicating a QR code does not give any right to uses in excess of the balance actually available.
Sherbeth may temporarily suspend accounts or codes where there are anomalies, suspected fraud or attempted manipulation, until the checks have been completed.
Art. 29
Account and credentials
#
Webapp login credentials are personal. Users are responsible for keeping them safe and must promptly report any unauthorised access.
Sherbeth may temporarily suspend an account where there are anomalies or security risks.
Operations carried out through the account before such a report remain attributable to that account, save for malfunctions or liability directly attributable to the system.
Art. 30
Closing the account
#
Users may request the deactivation of their account at any time from their personal area.
Deactivation does not delete the account or cause the loss of the balance: any Tasty held remain recorded and cannot be used while the account remains deactivated. At the user’s request, the account may be reactivated by the Organisation, and the Tasty become available again within the limits of their period of validity.
Before confirming deactivation, the user is warned that, while the account remains deactivated, the Tasty cannot be used, and is told which address to write to in order to request reactivation.
Reactivation requests are to be sent to info@sherbethfestival.it.
Users may also exercise the rights provided by data protection legislation, including the erasure of their data, by writing to the privacy contact point indicated in Art. 57. Erasure does not cover data that the joint controllers are required to retain for tax, administrative, accounting, security or legal obligations.
Art. 31
Suspension of the account
#
Sherbeth may suspend or, in the most serious cases, close an account in the event of:
- fraud or attempted fraud;
- manipulation or duplication of Tasty;
- anomalous use of the platform;
- serious breaches of these Terms;
- dangerous or unlawful conduct;
- use of the account for purposes contrary to the law.
The balance may be temporarily frozen during the checks. Once these are concluded, the balance will be restored or dealt with according to the nature of the findings and within the limits permitted by law.

Art. 57
Data processing
#
These Terms do not replace the full Privacy Policy.
For the processing connected with the webapp, bookings, the management of Tasty and the other activities for which they jointly determine the purposes and means, THE ITALIAN WAY - APS and GOOD EVENT SRL act as joint controllers.
The privacy contact point is: info@sherbethfestival.it
The joint controllers have set out their respective roles in a joint controllership arrangement. The essential content of that arrangement is made available to data subjects, who may request it from the contact point indicated.
Art. 58
Registration data
#
Registration on the webapp requires first name, surname, email and telephone number.
Having read the Privacy Policy and accepting these Terms are separate from any optional consents for marketing, profiling and the disclosure of data to partners.
Art. 59

#
Users may receive communications necessary for the management of the service through one or more of the following channels: the website, the webapp, email and WhatsApp.
Such communications may concern, for example, orders, bookings, waiting lists, technical problems, organisational changes and support.
Art. 60
Marketing
#
Subject to specific and optional consent, promotional communications concerning Sherbeth Festival and the joint controllers’ initiatives may be sent by email, telephone, WhatsApp and the other channels indicated in the Privacy Policy.
Withholding marketing consent does not prevent registration, the purchase of Tasty or the booking of events.
Consent may be withdrawn at any time by simple means made available through the website, the webapp, an unsubscribe link, the contact form, an email to info@sherbethfestival.it or the further channels indicated in the Privacy Policy.
Art. 61

The up-to-date list of recipient partners is published at https://sherbeth.it/partner/ and is indicated in the Privacy Policy.
Art. 62
Profiling
#
Subject to specific, separate and optional consent, Sherbeth may use data relating to the use of its services in order to build interest profiles and personalise content and communications.
The following may be used, within the limits set out in the Privacy Policy:
- purchases and quantities of Tasty;
- tastings taken;
- kiosks and products used, where technically detectable;
- events booked;
- attendance and no-shows;
- transfers of Tasty;
- participation in the various editions;
- interactions with the website and the webapp;
- campaigns and promotions;
- interests inferred from the use of the services.
Profiling will not be used to determine automatically prices, access, quantities of Tasty, booking priority or other contractual rights of the user.
Profiling may also concern users aged between 14 and 17, applying the specific safeguards provided by law and language suited to their age.
Data used for profiling will be kept, unless consent is withdrawn earlier, for a maximum of 36 months from the user’s last relevant interaction, as specified in the Privacy Policy.
Art. 63
Cookies and tracking technologies
#
The website and the webapp use, subject to the user’s consent where required by law, cookies and similar technologies for technical, statistical (analytics), advertising, conversion tracking and retargeting purposes.
The full rules on these tools, with the list of cookies, purposes, providers and retention periods, are set out in the Cookie Policy, published on the website and managed through a dedicated system for collecting and storing preferences (Iubenda). Users may change or withdraw the preferences expressed at any time through that same system.
Cookies and tools that are not necessary for the operation of the service are activated only after the user’s consent. Refusing those tools does not prevent the purchase of Tasty, the booking of events or the use of the essential features of the website and the webapp.
As at the date of this version, the processing connected with the services governed by these Terms relies on the following providers:
Hetzner (Germany): servers hosting the website and the webapp, and storage of uploaded files;
Stripe (United States): online payments;
A-Cube (Italy): certification of takings;
Resend (United States): service communications sent from the webapp;
Brevo (France): communications and sign-ups sent from the website, with two-step confirmation;
WhatsApp Business Platform by Meta (United States), with sending infrastructure by Twilio (United States): WhatsApp messages;
Iubenda (Italy): collection and storage of cookie preferences;
Google (United States): typefaces, map services, Google Analytics for the statistical measurement of visits, Google Tag Manager for tag management and Google Ads for advertising campaigns and conversion measurement;
Meta (United States): Meta Pixel for conversion measurement and retargeting on the Facebook and Instagram platforms.
Typefaces are requested from Google’s servers when the website’s pages load: that connection occurs automatically and independently of any action by the user.
Uploaded files are stored in Hetzner’s object storage, in Germany. Media content is served from the sherbeth.it domain: visitors do not contact that storage directly.
Stripe, Resend, Meta, Twilio and Google are companies based in the United States of America: the related data transfers are governed in the Privacy Policy, which states their legal basis.
The list of providers may be updated: the version in force is always the one set out in the Cookie Policy and the Privacy Policy.
